Human Rights Commission Code on Service Provision

GPPThe Statutory Code of Practice covering the provision of services, public functions and associations, issued by the Equality and Human Rights Commission under the Equality Act 2010, came into force on 6th April 2011.

Running to over 230 pages in PDF Format, the Code is a somewhat daunting prospect. In itself, the Code does not impose legal obligations. Nor does it state the law authoritatively – only the courts and tribunals can do that. However, the Code can be used as evidence in legal proceedings and courts and tribunals are obliged to take it into account in so far as it appears relevant. Certainly, when it comes to defending itself against a discrimination claim, a business will be in a much stronger position if it can show that it has complied with the Code.
