Agency Workers Regulations – Government Issues Final Guidance
The Agency Workers Regulations 2010 come into force on 1 October 2011. The Regulations give temporary agency workers the right to equal treatment in comparison to permanent workers as regards basic working conditions. They will apply to any agency worker engaged for more than 12 weeks, so will affect all but short-term temporary staff. Employers will need to review their temporary staffing policies as a result.
The Government has now issued the final draft of its guidance on the Regulations for agencies and employers using agency workers. Among other things, the guidance explains:
• what arrangements fall outside the scope of the Regulations;
• when the 12-week qualifying period for equal treatment is met;
• what constitutes pay for the purposes of the Regulations; and
• when agency workers will be entitled to bonus payments.
