Construction Litigation – Proposals to Reduce Cost
The recent review by Lord Justice Jackson on litigation costs has made proposals aimed to reduce the costs of construction litigation.
At present before proceedings are started the parties are obliged to undertake series of actions under a Court Protocol which involve great detail. The amount of detail required means the exercise can become very expensive.
Lord Justice Jackson has recommended that the Protocol is simplified so that less time is needed to comply with it and reduce costs, and also has recommended that consideration is given to abolishing the Protocol altogether in 2011.
