Administrative Restoration now available for Companies and LLPs struck off under The Companies Act 1985
Until now, a company struck off under the Companies Act 1985 could only be restored to the register by Court Order, with all the expense and hassle that that involved.
With effect from 1st October 2009, the Companies Act 2006 introduced a new procedure by which, provided certain conditions are met, a company may be restored to the register simply by application to Companies House. In its original Guidance, Companies House took the view that the new procedure could only be used by companies struck off the register under the 2006 Act. In a welcome change of view, Companies House has now amended its Guidance to make the new procedure available to companies struck off under the 1985 Act. This change also applies to Limited Liability Partnerships struck off under the 1985 Act.
