New Guidance On Illegal Working Issued
The UK Border Agency has published new guidance for employers on the prevention of illegal working. This updates guidance originally published in February 2008, when the illegal working civil penalty regime was first introduced. Under that regime an employer may incur a civil penalty of up to £10,000 per illegal worker employed.
The guidance includes details of document checks that employers are advised to undertake, and images of the current documents, stamps and endorsements that may be presented by migrant workers as evidence of their right to work in the UK. It confirms that employers can accept evidence of status in expired passports and travel documents (with certain exceptions), and contains new appendices on employing asylum seekers, refugees and students. It also provides updated contact details for further support and information.
