Failing to Pay the National Minimum Wage
All the signs are that the Government is intent on cracking down on employers who fail to pay the National Minimum Wage (NMW).
When the Employment Bill currently before Parliament become law, it will beef up the enforcement powers of Revenue & Customs [or HMRC] in relation to non-payment of the NMW. It will also provide for an increased amount to be payable to an employee where NMW arrears have been outstanding to take account of the period for which the arrears have been due.
Meanwhile, we have now had the first prosecution for deliberate non-payment of the NMW. The father and daughter owners of a butcher's shop in Yorkshire found themselves facing a bill of over £11,000 made up of fines, costs and compensation to the relevant employees.
