Divorce mediation is a voluntary dispute resolution process designed to help separating or divorcing couples resolve conflicts and reach mutual agreements without going to court. A neutral third party, known as a family law mediator, facilitates structured discussions to promote a fair and amicable resolution. Mediation is increasingly recognised as a preferred method for resolving family disputes, including those involving child custody, financial settlements, and property division.
The process usually begins with an initial consultation where the mediator explains how the mediation sessions will be conducted. While the approach may vary depending on the nature of the issues, financial mediation involving married couples typically requires full financial disclosure. Each party must share details about their income, savings, property, debts, and liabilities to ensure transparency and fairness.
Mediation is often conducted over multiple sessions—typically four or five—during which parties discuss their goals and work towards a settlement. The mediator facilitates the conversation, suggests possible solutions, and helps the parties communicate constructively. Importantly, the mediator remains impartial and does not provide legal advice.
Once an agreement is reached through mediation, both parties are encouraged to seek independent legal advice. A solicitor can then help convert the mediated agreement into a legally binding consent order or another appropriate legal document. This step ensures that both parties’ rights and responsibilities are clearly documented and enforceable.
