Buying a home is one of the most exciting milestones in life, but it also comes with a significant amount of administrative groundwork. For many buyers, especially first-time purchasers, getting onto the property ladder is often made possible through a gifted deposit, where a parent, family member, or close friend provides funds toward the purchase without expecting repayment.

While receiving a financial gift is a major boost, it introduces specific legal and regulatory requirements. Under the Solicitors Regulation Authority (SRA) Anti-Money Laundering (AML) guidance and UK Money Laundering Regulations, conveyancers and solicitors are legally obligated to verify both the identity of the donor and the legitimate source of funds.

Knowing what documentation is required from the outset is the single best way to prevent frustrating delays and ensure a smooth, swift path to completion.

Why Conveyancers Must Check Gifted Deposits

Solicitors are bound by strict SRA rules to prevent financial crime. When a third party provides money for a property transaction, your legal team must carry out thorough checks on both you and the gift donor. This is not a matter of visual suspicion or lack of trust; it is a strict statutory requirement that every UK conveyancer must fulfil before funds can be drawn down or contracts exchanged.

To satisfy these regulations, your solicitor needs to prove two key things:

  1. Source of Funds: Where the deposit money originated (e.g., savings, sale of shares, inheritance).
  2. Donor Intent: Written confirmation that the money is an unconditional gift, not an informal loan, and that the donor will hold no legal interest in the property.

What Evidence Will You and Your Gift Donor Need?

To satisfy SRA AML requirements, your donor will typically need to provide:

  • Proof of Identity: Official photo ID (such as a valid passport or driving licence) and recent proof of address (such as a utility bill or bank statement less than three months old).
  • Bank Statements: At least 6 months of bank statements showing the funds sitting in their account, along with evidence showing how those funds built up (e.g., regular salary savings, a lump-sum inheritance payout, or property sale proceeds).
  • Signed Gifted Deposit Letter: A formal declaration signed by the donor confirming that the money is a non-repayable gift and that they will have no financial claim over the home. If the gift is for a significant amount of money then confirmation that the donor has received Independent Legal Advice may also be required.

The conveyancing process involves many moving parts, searches, surveys, mortgage offers, and legal enquiries. AML checks on third-party funds are frequently one of the biggest bottlenecks when buyers are caught off-guard.
